Welcome to Otis Wheat Photography! We are delighted to have you as our customer. These Terms of Service (“Terms”) govern your access to and use of Otis Wheat Photography services, including our website, products, and services (collectively, the “Services”). By using our Services, you agree to comply with and be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.
2. Services
Otis Wheat Photography offers professional photography services, including but not limited to portrait, event, wedding, commercial, and landscape photography. We also provide digital and printed photo products.
3. Bookings and Payments
• Booking Process: All photography sessions must be booked in advance. Bookings can be made through our website, via email, or by phone.
• Deposits: A non-refundable deposit may be required to secure your booking. The deposit amount and payment instructions will be provided at the time of booking.
• Payment Terms: Full payment is due on the day of the photography session, unless otherwise agreed upon in writing. We accept various payment methods, including credit/debit cards and bank transfers.
• Cancellations and Rescheduling: Cancellations must be made at least 48 hours before the scheduled session to avoid a cancellation fee. Rescheduling is subject to availability and may incur additional fees.
4. Client Responsibilities
• Timeliness: Clients are expected to arrive on time for their scheduled sessions. Late arrivals may result in a shortened session or rescheduling.
• Attire and Preparation: Clients should come prepared with appropriate attire and any props or items they wish to include in the photoshoot. Otis Wheat Photography is not responsible for providing attire or props.
• Conduct: Clients are expected to conduct themselves respectfully and professionally during the session. Otis Wheat Photography reserves the right to terminate a session without refund if the client behaves inappropriately or violates these Terms.
5. Intellectual Property
• Ownership: Otis Wheat Photography retains all rights, title, and interest in and to the photographs taken during the session. Clients are granted a limited license to use the photographs for personal, non-commercial purposes, unless otherwise agreed upon in writing.
• Copyright: All images are protected by copyright laws. Clients may not reproduce, distribute, or sell the photographs without the express written consent of Otis Wheat Photography.
• Watermarking: Proof images provided to clients may contain watermarks. Final images will not contain watermarks unless specifically requested by the client.
6. Image Delivery
• Turnaround Time: The typical turnaround time for image delivery is one week from the date of the review session. Rush services may be available for an additional fee.
• Format: Images will be delivered in digital format through a secure online gallery. Prints and other products may be ordered separately.
• Image Selection: Clients may have the opportunity to select their favorite images for final editing. Additional editing requests may incur additional fees.
7. Liability
• Limitation of Liability: Otis Wheat Photography is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our Services. Our liability is limited to the amount paid by the client for the specific session or service in question.
• Force Majeure: Otis Wheat Photography is not responsible for any delays or cancellations due to circumstances beyond our control, including but not limited to natural disasters, health emergencies, or equipment failure.
8. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
9. Amendments
Otis Wheat Photography reserves the right to amend these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of state of Maryland. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in state of Maryland.
